Jeremiah Oliver Missing: Mother of Missing Boy Declared Mentally Competent, Uncle Has Outburst in Courtroom

A courtroom in Fitchburg, Mass. erupted in upheaval on Friday when the uncle of missing 5-year-old Fitchburg boy Jeremiah Oliver shouted at the boy's mother to tell him where the boy is. Just moments before, the boy's mother, Elsa Oliver, had been declared mentally competent to stand trial.

According to Boston.com, Sandrino Oliver would not let relatives or friends silence him in Fitchburg District Court. He shouted at Jeremiah's mother as she was led from the courtroom. 

"Where's my nephew? What happened to my nephew?" Oliver screamed while simultaneously crying. 

Court officers wrestled him out of the courtroom. Once outside of the courtroom, Oliver ran down the street, stopped and began to sob. Police approached him, spoke to him then convinced him to return back to the courthouse. 

After the returned to the courthouse, he was taken into custody by court officers to face a contempt of court charge. He appeared before Judge Margaret Guzman, who dismissed the charge after making him promise that he would not repeat his disruptive behavior. 

The incident occurred after a brief hearing before Judge Guzman, in which the judge said Elsa Oliver was competent to stand trial. The ruling came after Oliver, 28, was examined by mental health professionals. 

James Reardon Jr., Oliver's defense attorney, said he was not convinced that she was capable of communicating with him, despite the judge's ruling. 

Reardon said he is willing to consider a request by Jeremiah Oliver's biological father, Jose Oliver, to meet with his estranged wife and ask her what happened to Jeremiah, who is their youngest son. 

Jose Oliver told reporters that his sister-in-law had spoken with Elsa recently. He said Elsa asked about Jeremiah, but without any emotion, and asked at one point in the conversation, "Is it the Rapture?"

Nonetheless, Jose said he does not believe Elsa is mentally ill. 

Elsa Oliver is being held on high bail after pleading not guilty to charges that she allowed her boyfriend, Alberto L. Sierra Jr., 22, to abuse Jeremiah. Sierra has pleaded not guilty on all charges. 

Joseph D. Early Jr., the Worcester District Attorney, said he fears Jeremiah was murdered. 

Authorities learned he was missing last month when Oliver's sister told Fitchburg school officials that she and her siblings were being abused. She said that when she last saw her brother, his hand was bleeding and their mother was worried that he would die from the serious injury. 

The Department of Children and Families is facing intense scrutiny for not protecting the Oliver children after the agency said a social worker assigned to the family did not visit the home. DCF has since fired the social worker and two supervisors. 

In a report made public Thursday, the Office of Child Advocate concluded that DCF did not perform home visits in almost 1 out of 5 cases.
